TRAINING PLAN ACCESS AGREEMENT & LIABILITY RELEASE
This agreement is entered into between NYX Endurance, LLC ("NYX Endurance") and the undersigned athlete ("Athlete").
Nature of Service
Athlete is purchasing access to a training calendar at a rate of $40/month. This service provides workout scheduling only. The training plan was designed for another athlete and has not been created, modified, or individualized based on Athlete's fitness history, training background, injury history, health status, or personal goals. This arrangement does not constitute a coaching relationship, and NYX Endurance has no ongoing duty to monitor, adjust, or evaluate Athlete's training.
Training Zones
Workouts may include intensity targets expressed as percentages of threshold or as zone descriptors (e.g., Zone 1, Zone 2). Athlete is solely responsible for entering, maintaining, and verifying the accuracy of their personal training zones within the training platform. NYX Endurance makes no representation as to the appropriateness of Athlete's self-entered zones and is not responsible for any outcomes resulting from inaccurate, outdated, or incorrectly entered zone data.
Athlete Responsibility
Athlete acknowledges that it is their responsibility to:
- Determine whether any given workout is appropriate for them on a given day
- Modify, skip, or substitute workouts based on how they feel, current fitness, fatigue, or any other factor
- Consult a licensed physician before beginning or continuing a vigorous training program
- Disclose any relevant medical conditions or physical limitations prior to accessing the plan (see Intake Form)
Assumption of Risk & Liability Waiver
Athlete understands that endurance training involves inherent risks including but not limited to cardiovascular stress, musculoskeletal injury, and overtraining. By signing this agreement, Athlete voluntarily assumes all such risks. Athlete releases and holds harmless NYX Endurance, their agents, and affiliates from any and all claims, damages, injuries, or losses arising from Athlete's participation in or use of the training plan, including those resulting from NYX Endurance negligence.
No Coaching Services
This agreement does not include training feedback, plan modifications, communication, or any other coaching services. Athlete agrees not to contact NYX Endurance for coaching advice as part of this arrangement. Should Athlete wish to receive individualized coaching, a separate coaching agreement would be required.
Acknowledgment
By signing below, Athlete confirms they have read and understood this agreement, are 18 years of age or older, and are voluntarily entering into this arrangement.
